# A second Tesla Full Self-Driving crash in nine days, this one fatal, lands on the December Cybercab date

> A 71-year-old man died on Interstate 80 with the driver reporting Full Self-Driving engaged, nine days after a sleeping driver's Tesla injured two California Highway Patrol officers. The same week, Tesla dated its first Cybercab deliveries for year-end.

## A man stepped onto I-80 at 2:30 a.m.

At about 2:30 a.m. on October 22, a 71-year-old Vallejo man stepped onto westbound Interstate 80 from the right shoulder, near the I-780 interchange in Solano County [1][3]. A [Tesla](https://theinference.org/markets/companies/tesla) doing about 70 mph braked and swerved left; its right front corner hit him anyway [1][3]. The 26-year-old San Francisco driver stopped, [handed investigators the dashcam recording](https://www.wmur.com/article/tesla-full-self-driving-deadly-crash-california/74227123), and said the car was in Full Self-Driving, Tesla's supervised driver-assist system [1][3].

At least one other vehicle ran over the man where he lay, and no other driver stopped [1][2]. The Tesla driver was not cited, and the district attorney can still file charges if negligence is found [2][3]. The California Highway Patrol, or CHP, is still working out why the man was on the freeway; he did not appear to be a stranded motorist [3]. The crash came the morning after Tesla put [a dated Cybercab milestone](https://theinference.org/article/tesla-dated-cybercab-sales-to-outside-fleets-for-december-full-self-driving-subscribers-wait-until-2027) in front of investors [5].

## Nine days earlier, a cruiser with its lights on

On October 13, a 22-year-old Sacramento driver told investigators he was asleep when his Tesla, running Full Self-Driving, drove through cones closing four lanes of I-80 near Fairfield and struck a CHP Dodge Charger [3][4]. Three patrol vehicles had their emergency lights on [3]. Two officers were seriously injured and were out of the hospital within days [3][4].

CHP [posted the video as a warning to other drivers](https://www.fox26houston.com/news/dashcam-tesla-driver-claims-he-was-asleep-self-driving-before-hitting-chp-cruiser-injuring-2): "Despite its name, full self-driving is not fully autonomous" [4]. That sentence now sits in the record beside a fatality investigation, on the same corridor, nine days apart.

## The calendar these files land on

The calendar opened the day before the crash. On October 21, Tesla engineering vice president Lars Moravy told investors the company is "[trying to get Cybercabs to customers by the end of this year, 2026](https://www.teslarati.com/tesla-cybercab-gets-sale-date-at-last/)," while [every unit built so far goes to Tesla's own robotaxi fleet](https://theinference.org/article/tesla-s-robotaxi-math-476-registered-8-carrying-riders-one-sworn-deadline) [5][6]. Unsupervised Full Self-Driving on customer-owned cars is expected in the second quarter of 2027 [5][6].

The subscription money behind that promise is real: 1.74 million active Full Self-Driving subscriptions at $99 a month, up 67 percent in a year [6][7]. The car business underneath is thinner. Operating margin was 2.6 percent last quarter against 8.2 percent in late 2023, and a $1.53 trillion valuation, roughly 400 times earnings, rides on the dates [6][9].

That is the exposure: Tesla's autonomy calendar now has a fatality investigation attached to it, nine days after a cruiser crash, both on the same stretch of Interstate 80.

*Chart: **Operating margin slid from 8.2 to 2.6 percent while Tesla dated its autonomy calendar** Column chart of Tesla's quarterly operating margin from Q4 2023 to Q3 2026, falling from 8.2 percent to 2.6 percent.*

*Operating margin as percent of revenue; Tesla quarterly SEC filings, Q4 2023 through Q3 2026. [9]*

## The record regulators already hold

The National Highway Traffic Safety Administration, NHTSA, has opened [46 special crash investigations into Teslas running self-driving or driver-assist technology](https://www.nbcnewyork.com/news/national-international/tesla-federal-probe-deadly-model-3-crash-texas/6516836/) over the past decade, and more than a dozen of those crashes killed someone [8]. [An NBC tally published in September](https://insideevs.com/news/807893/tesla-sleeping-congress-nhtsa-demand/) counted 43 videos of drivers asleep with Full Self-Driving engaged and 13 California citations, and Representative Raja Krishnamoorthi has pressed NHTSA to say whether the misuse amounts to a safety defect [7].

A separate open probe already covers 3.2 million Full Self-Driving-equipped Teslas [7]. The defense is on the record too: Tesla sells the software as supervised and requires an attentive driver, the October 22 driver was described by CHP as alert and ready to take over, and no one has been charged in either crash [3][4].

Nothing made public so far ties the software itself to the death on I-80; the open question in the CHP account is driver negligence [3]. Three things will tell investors what these crashes are worth: the district attorney's charging decision [3], where the 3.2-million-car federal probe lands [7], and whether a Cybercab reaches a customer outside Tesla before December ends [6].

## Takeaway

Two Full Self-Driving crashes in nine days on the same stretch of Interstate 80, one of them fatal, land on Tesla just as it dates the first Cybercab deliveries for December; the district attorney's charging decision and the 3.2-million-car federal probe now share a calendar with the robotaxi rollout.
