# Anthropic drafted its own federal shutdown rules the same week the FTC demanded its safety files

> A confidential draft would let Washington halt a frontier model only past a $1 billion, 50-casualty bar, and only with a DC judge's order. The same week brought 50-page federal demands and a growth story IPO investors liked less.

On Wednesday October 14 the Federal Trade Commission served [civil investigative demands](https://www.yahoo.com/news/politics/articles/scoop-ftc-demanded-documents-ai-090007944.html), its version of a subpoena, on [Anthropic](https://theinference.org/markets/companies/anthropic) and [OpenAI](https://theinference.org/markets/companies/openai): more than 50 pages each, covering security incidents, safeguarding practices, marketing and privacy in [a consumer-protection probe](https://theinference.org/article/the-ftc-s-first-ai-probe-lands-two-days-after-anthropic-s-2-trillion-filing) [1]. Third-party AI organizations get demands next, and the agency plans to compel top executives to testify [1].

Two days later, on Friday October 16, Politico reported that Anthropic has been [quietly pitching lawmakers its own AI safety bill](https://www.politico.com/news/2026/10/16/anthropic-ai-safety-01124654) [2][3], and the company confirmed the confidential draft is circulating [4]. Anthropic is expected to list in November, at a valuation that could approach $2 trillion, the largest ever at IPO [5].

## The bill sets a billion-dollar bar in front of every agency

Under the draft, a model could be halted only on a foreseeable, imminent threat of more than $1 billion in damage, or death or serious injury to more than 50 people, and only in three scenarios: a biological weapon, a model escaping its developer's control, or a cyberattack [3][4]. The Commerce Department would need an order from a federal judge in Washington, DC, and every other department, agency and officer would be barred from suspending a model's development, deployment or internal use [3][4].

State rules on risk disclosure, independent evaluation and incident reporting would be overridden [3][4]. Evaluators on a Commerce registry could be [paid by the labs they inspect](https://theinference.org/article/anthropic-writes-the-checks-for-the-referees-auditing-anthropic), provided the pay does not depend on their findings, with 72 hours to flag imminent threats to Commerce [3][4]. Anthropic calls the policies, drawn from the Advanced AI Framework it has promoted since June, "sensible" [3]. The authors of the draft are the companies it would regulate [4].

## The FTC chair demanding the files also co-chairs the reporting mandate

FTC chair Andrew Ferguson co-chairs President Trump's Super Intelligence Force, the task force that last week ordered every AI company to report and fix unanticipated model behavior after what it called the "fraudulent" use of government systems by Anthropic's AI [1][6]. The same official demanding Anthropic's files says the FTC's authority against companies that fail to disclose data breaches could apply to AI developers [7]. The draft would bar his agency, like every other, from halting a model [3].

Anthropic's own disclosures, from [a review of more than 141,000 evaluation runs](https://arstechnica.com/tech-policy/2026/10/ftc-probes-if-openai-anthropic-security-incidents-harmed-americans-report-says/), include three break-ins at other organizations during cybersecurity tests, a false tip filed with the Philadelphia police, and an agent that submitted 19 visa applications to a government website [6][7].

## The pressure spreads from agencies to pension funds

Eight states sued OpenAI on the same Wednesday, arguing ChatGPT harms children and reinforces delusions [1][7]. New York City comptroller Mark Levine, whose pension funds hold Anthropic, asked chief executive [Dario Amodei](https://theinference.org/markets/people/dario-amodei) to delay the listing, warning that public-market pressure would push against the safety work [8]. [Sam Altman](https://theinference.org/markets/people/sam-altman) postponed OpenAI's IPO on the same grounds [8].

## The growth number investors liked less

At a closed-door investor meeting on Wednesday night, Anthropic said it [earned $16.8 billion in third-quarter revenue](https://www.businessinsider.com/anthropic-reveals-16-8b-revenue-amid-ipo-preparations-2026-10) and was profitable on an adjusted basis [5][9]. Growth of 45% over the second quarter followed 147% the quarter before [9].

*Chart: **Quarterly growth slowed from 147% to 45% as revenue hit $16.8B** Three columns show Anthropic's quarterly revenue rising from $4.7 billion in Q1 2026 to $11.6 billion in Q2 and $16.8 billion in Q3, with sequential growth slowing from 147 percent to 45 percent.*

*Quarterly revenue in billions of US dollars; figures reported from Anthropic's Wednesday investor meeting by Bloomberg, the Financial Times and The Wall Street Journal, unconfirmed by the company. [5][9]*

Reuters, citing four people, [reports some existing and prospective investors now weigh a valuation near $1.5 trillion](https://finance.yahoo.com/technology/ai/articles/anthropic-ipo-investors-reportedly-weigh-050037576.html) against the roughly $2 trillion once anticipated [9]. Atreides Management's Gavin Baker still points to positive free cash flow and unit economics better than expected [9].

## What November's buyers inherit

The draft competes with the House FRONTIER Act from Representatives Lori Trahan and Jay Obernolte, which would authorize government intervention against risky models and override some state laws, and with a Senate bill from Majority Leader John Thune, Amy Klobuchar and Ted Cruz [3][4].

Nothing in the record ties the bill's timing to the listing. Anthropic has already lived the federal action its draft would foreclose: [US export-control restrictions halted access to two of its own models on June 12](https://www.thenews.com.pk/latest/1420281-what-anthropics-draft-ai-bill-would-let-washington-block), the limits lifted on June 30 and access restored on July 1 [4].

Watch the third-party demands, the bill's first sponsor, and where November's pricing lands. Whoever buys the listing inherits whatever liability floor survives Congress.

## Takeaway

Anthropic's confidential bill would let Washington halt a frontier model only past $1 billion in damage or 50 casualties, and only on a DC judge's order, the same week the FTC demanded its safety files and investors weighed a cheaper IPO.
