# AppLovin failed to switch off Unity's ad tool in court; a class action cites $44 billion of lost value

> A San Francisco judge has pushed AppLovin's fight with Unity over who owns ad-auction data into arbitration no shareholder can read. A securities class action is pressing the harder question: when management knew the model "uplift" had gone "lighter than normal," after two drops erased more than $44 billion.

## The charge: theft at the auction

On October 2, 2026, a San Francisco judge [denied AppLovin's emergency bid to switch off parts of Unity's Ad Quality SDK](https://shattered.io/applovin-sues-unity-ad-quality-sdk-2026/), the free tool publishers install to catch bad ads [1]. [The filing was blunt](https://www.marketscreener.com/news/judge-denies-applovin-s-request-for-temporary-restraining-order-against-unity-in-ad-data-case-ce785ddbd98bf726): [Unity](https://theinference.org/markets/companies/unity) "is abusing its position as a bidder in [AppLovin](https://theinference.org/markets/companies/applovin)'s platform to steal AppLovin's Protected Data" [2]. The alleged haul runs from ad creatives and device identifiers to impression revenue, auction clearing prices and waterfall configurations, all tied to ads AppLovin's MAX mediation served [1]. The arbitration demand reached JAMS on September 27; the court petition followed a day later [1].

## The merits go where no shareholder can read

The denial settled urgency, not guilt. The contract and trade-secret claims now sit in confidential arbitration [1]. [A written order is pending, with a hearing on sealing set for October 23](https://www.streetinsider.com/General+News/AppLovin+shares+fall+after+court+denies+request+against+Unity/27139266.html) [3]. APP fell more than 5% premarket, touched a 52-week low of $266.84 [1][2] and is down roughly 60% in 2026 [4]. The bleeding started before the gavel: a Wells Fargo note argued growth in AppLovin's web-tracking pixel traced to low-to-no-traffic sites in Asia, "suggesting some sort of data error" [2].

## The other ledger: $44 billion in two sessions

[Camp two is already in court](https://theinference.org/article/applovin-said-its-ai-gains-wouldn-t-slow-the-stock-fell-55-and-buyers-are-suing). A securities class action covering buyers from February 12 to August 5, 2026, [lead-plaintiff deadline November 16](https://www.prnewswire.com/news-releases/app-investor-deadline-applovin-corporation-investors-with-substantial-losses-have-opportunity-to-lead-the-app-securities-fraud-class-action-lawsuit-302902644.html), hangs on two drops: 12.6% on July 13 after an analyst report and 19.6% on August 5 after Q2 results, together more than $44 billion of market value [5]. The concession anchors it: "Our pace of meaningful model improvement was lighter than normal during the quarter" [5]. The slope was in the filings before anyone sued.

*Chart: **AppLovin's revenue growth has slowed five straight quarters** Line chart of AppLovin's year-over-year revenue growth falling from 77% in Q2 2025 to 52.8% in Q2 2026*

*Year-over-year revenue growth by calendar quarter, as reported in AppLovin's SEC filings; all figures reported, none estimated. [6]*

## The defense: a run rate that argues for itself

Unity calls Ad Quality "a small, free product" run with publisher authorization, and says AppLovin "clearly believes" the data customers share "is driving our sharply improving performance" [1]. It is improving: [Vector grew 23% sequentially in Q2 and hit a $1 billion annualized run rate two quarters early](https://finance.yahoo.com/markets/stocks/articles/unity-software-inc-u-q2-231447247.html), with chief executive Matt Bromberg crediting "higher-quality data" and "compounding model improvements" [7]. No public record shows Vector was trained on AppLovin's data; Unity denies it [1]. The SEC, for its part, [closed its inquiry into AppLovin with no action recommended](https://www.ad-hoc-news.de/boerse/news/corporate-news/applovin-stock-gains-6-25-percent-as-q3-guidance-stays-central/70234363) [8].

## The verdict watch: November 4, then November 16

[November 4 brings Q3 results against a 46 to 48% growth guide](https://finance.yahoo.com/markets/stocks/articles/applovin-announce-third-quarter-2026-200500229.html), with [price per install finally counted against install volume](https://theinference.org/article/applovin-s-52-8-growth-rides-price-per-install-not-volume-november-4-counts-both) [9][8]. November 16 closes the door for lead plaintiffs. Unity, one-fifth AppLovin's size, has watched its shares rise 5.2% over the five sessions since the ruling [2]. Unity keeps measuring the auctions; shareholders can read neither the data nor the defense.

## Takeaway

The TRO denial moves AppLovin's data dispute into private arbitration, but the securities class action over more than $44 billion in lost value turns on the same timing question: what management knew when the model's uplift went lighter than normal.
