# Arm fell 4% on a hung-jury label no verdict supports; the judge holds the $1.5 billion Qualcomm royalty call

> Jurors return to Wilmington today after four hours without a verdict, and ARM fell about 4% Monday on hung-jury headlines the record does not support. The ruling that could halt Qualcomm's royalties for five years sits with Judge Maryellen Noreika, and it lands on Arm far harder than on Qualcomm.

[Arm](https://theinference.org/markets/companies/arm) Holdings, whose chip architecture sits under nearly every smartphone, [fell about 4% on Monday](https://news.jkn.co.kr/editions/english/post/1019163) as financial outlets declared that the Delaware jury in its licensing fight with chipmaker [Qualcomm](https://theinference.org/markets/companies/qualcomm) had hung [1][2]. The record says less: [jurors deliberated for about four hours on Friday](https://www.kansascity.com/news/business/article317552895.html), went home, and return to Wilmington today, and no mistrial has been declared [3][4]. The market traded a label. The decision that moves Arm's income statement belongs to Judge Maryellen Noreika, not to the jury.

## The judge holds the five-year royalty holiday

Qualcomm says Arm withheld software patches and design tools it was owed, broke a promise to keep Qualcomm's price within 10% of Arm's lowest, and leaked a 2024 breach letter to Bloomberg to poison Qualcomm's chip talks with [Meta](https://theinference.org/markets/companies/meta) [3][4]. The remedy is what matters: Qualcomm wants Noreika to enforce a clause letting it [stop paying Arm royalties for five years if a breach is proven](https://theinference.org/article/qualcomm-asks-a-jury-to-let-it-stop-paying-arm-royalties-for-five-years) [3]. She has not ruled; Arm calls the clause unenforceable and told jurors Qualcomm was "not harmed in the least" [3]. The holiday would be worth about $1.5 billion, roughly five years of royalties [4]. Without the clause, a win opens only an ordinary damages claim [5].

## One payment, two income statements

Qualcomm's payments were [9% of Arm's revenue last fiscal year](https://finance.yahoo.com/markets/stocks/articles/qualcomm-waits-jury-arm-443-114215008.html), license fees included [5]. They equal roughly half of Arm's operating profit [5][6]. Next to Qualcomm's operating profit over the past four quarters, they barely register [7]. That asymmetry is why the clause ruling matters more to Arm holders than to Qualcomm's: the penalty that would pinch Qualcomm would reprice Arm.

*Chart: **Qualcomm's payment is about half of Arm's operating profit and a rounding error at Qualcomm** Bars comparing Qualcomm's yearly payment to Arm with each company's operating income*

*Annual basis, USD. Payment is Qualcomm's total license and royalty payments, about 9% of Arm's fiscal 2026 revenue (Arm filing, year ended March 2026). Operating income from SEC filings; Qualcomm on trailing four quarters ended June 2026. [5][6][7]*

## A phone-era cap meets the AI data center

The pricing fight underneath is the real story. A 2013 deal caps Arm's royalty at $1.88 per chip for any chip with five or more CPU cores, written when a large chip was a phone flagship [5]. Data-center processors now carry 288 cores [4][5]. Qualcomm holds an Arm architecture license through 2033 [3] and [expects $5 billion of data-center revenue in fiscal 2027](https://finance.yahoo.com/markets/stocks/articles/qualcomm-arm-trial-ends-hung-130049760.html) [2], which it has every reason to defend at that capped rate. Its chief executive, Cristiano Amon, testified that [Arm's proposed royalty step to its next architecture is a 1,800% increase](https://www.msn.com/en-us/money/general/chip-royalty-war-heads-to-jury-qualcomm-seeks-1-5b-from-arm-as-ftc-watches/ar-AA2dW0L1) [4]. A bench trial, decided by the judge alone, has just closed on whether Arm negotiated that price in good faith [3].

## Arm holders carry the model risk

Arm's shareholders carry the risk from more than one direction. The company began selling chips of its own in March, competing with the customers it licenses to, and the Federal Trade Commission opened an antitrust investigation into its licensing in May [4]. What an Arm design is worth when a processor carries hundreds of cores is being settled by a jury, a judge and a regulator at once. Watch Noreika's clause ruling and the good-faith decision rather than the jury box; [Arm reports fiscal Q2 on November 4](https://www.ad-hoc-news.de/boerse/news/corporate-news/arm-holdings-faced-qualcomm-trial-as-arm-holdings-stock-stands-at-eur-234-75/70300430) [8].

## Takeaway

Trade the judge, not the jury: the hung-jury headline is not in the record, and the ruling that could stop Qualcomm's royalties, worth about $443 million a year or half of Arm's operating profit, sits with Judge Noreika.
