# Chile charges Enel over phantom meters; Brazil's regulator votes to recommend ending its largest concession

Two days, two countries, one utility. On October 6, Brazil's ANEEL cut short its own vote on tearing up Enel São Paulo's concession, with the score at 2-0 in favor of [recommending termination](https://canalsolar.com.br/en/Aneel-postpones-end-of-Enel-SP-concession./) [3]. On October 8, Chilean deputy Zandra Parisi [announced a criminal complaint for illicit enrichment](https://www.adnradio.cl/2026/10/08/diputada-parisi-denuncia-a-enel-por-cobros-fantasmas-y-pide-investigar-eventual-enriquecimiento-ilicito/) over the phantom meters [1][2]. The company behind both headlines is now under pressure from regulators and prosecutors in its two biggest Latin American markets at once.

## The meter knew before the household did

Chile's case is a paper trail problem. A [technical report Enel itself commissioned](https://www.t13.cl/noticia/nacional/cobros-fantasmas-luz-enel-sabia-hace-16-meses-7-10-2026), dated May 28, 2025, concluded that the NANSEN N12U01 meter could record currents that did not correspond to customer consumption, meaning the meter "could make erroneous energy registrations" [5]. Chile's electricity regulator, the SEC, has since [filed formal charges](https://www.radioagricultura.cl/noticias/politica/diputada-zandra-parisi-anuncia-querella-contra-enel-por-presunto-enriquecimiento-ilicito-tras-cobros-fantasmas_20261008/) against Enel Distribución Chile [2][5]. More than 56,000 homes in the Metropolitan Region are affected; Parisi cites bills that went from about 4,000 pesos past 400,000, with some cases over 1.3 million pesos [1][2].

Enel says it only recently learned the full extent of the problem, has replaced 13,602 meters across more than 20 comunas as of October 6 with roughly 110 dedicated crews, and is adjusting billing where warranted [1][5]. Parisi does not accept the framing: "hay que ver si existió un enriquecimiento ilícito", whether the company illicitly enriched itself, and she wants the investigation widened to "many more involved" [2]. That is an allegation, not a finding; no court has ruled.

## Brazil: 2-0, then a pause

The São Paulo concession, about 8.5 million consumer units and the largest in Brazil by customer count, got here through escalating blackouts: storms left more than 2 million customers without power in November 2023 and more than 2 million properties out again in October 2024, before the December 2025 extratropical cyclone set the record at more than 4.2 million properties and [pushed the formal termination process open](https://theinference.org/article/enel-s-sao-paulo-concession-now-waits-on-a-minister-named-in-a-banker-s-seized-messages) in April 2026 [3]. Directors Agnes Costa and Ludimila Lima voted for recommending early termination; director Gentil Nogueira then requested review, which forces the agenda to resume within 60 consecutive days [3]. The final call on extinction sits with the mines and energy ministry. Federal prosecutors at the TCU have [asked for a consensual, negotiated solution](https://www.oliberal.com/variedades/mp-junto-ao-tcu-pede-solucao-consensual-para-enel-sao-paulo-1.1178784) instead [4], and that is the fork that decides the money: a termination fight leaves what Enel recovers contested, while a negotiated exit would fix it in advance.

## The market has not flinched

[Morgan Stanley](https://theinference.org/markets/companies/morgan-stanley) [cut its Enel target from €9.20 to €8.50 and kept Underweight](https://www.ad-hoc-news.de/boerse/news/corporate-news/morgan-stanley-cuts-target-for-enel-stock-to-eur-8-50/70275416) on October 9; the stock closed the session up 0.34 percent at €8.84, €1.47 off its 52-week high [6]. The tail risk has not been priced yet.

## The tell

Two dates now carry it. Enel's next nine-month report lands on November 12 [6]. Then the ANEEL board must return to the case within 60 days of October 6, by early December, after Brazil's run-off [3]: two votes for termination and a ministry that must choose between a termination fight and a negotiated sale that fixes what Enel recovers. One meter report, dated May 28, 2025, sits under both stories.
