# Five hospitals say Lilly cut off tens of millions in 340B discounts until they hand over patient data

> Five Massachusetts hospitals say Eli Lilly cut off tens of millions in 340B drug discounts until they surrender patient claims data to a private-equity-owned platform. Lilly calls it fraud policing, and the same gross-to-net machinery under dispute just produced a record $24.4 billion quarter.

Five Massachusetts hospitals [walked into US District Court in Boston on October 28, 2026](https://www.boston.com/news/the-boston-globe/2026/11/04/mgh-brigham-other-hospitals-sue-eli-lilly-alleging-extortion-in-drug-discount-program/), and accused the first trillion-dollar drugmaker of a shakedown [1]. Massachusetts General, Brigham and Women's, Salem, UMass Memorial Medical Center and UMass Memorial Health-Harrington say [Eli Lilly](https://theinference.org/markets/companies/eli-lilly) withheld 340B discounts worth tens of millions of dollars a year until they hand over patient claims data, and the complaint does not mince words: "corporate extortion," Lilly holding "vital 340B drug savings hostage" [1].

Dr. Patrick Gordan, Salem Hospital's associate chief medical officer, gave the ward-level version: 340B savings keep community health centers open, bring cancer screenings to neighborhoods by van, and no hospital should trade patient trust for them [1].

## A statutory discount now comes with a toll booth

The 340B program is federal law, not a contract: manufacturers must sell outpatient drugs at deep discounts to organizations serving the uninsured and poor [2]. [Lilly announced in January that it would require claims-level data before honoring those prices](https://www.fiercehealthcare.com/providers/eli-lillys-340b-data-policy-draws-new-opposition-missouri-ag-massachusetts-hospitals), and first enforced it on a subset of hospitals in June [2].

The data must flow through 340B ESP, which the complaint calls "a unilaterally selected, private-equity-owned third-party platform," where de-identification is superficial, data can be used beyond integrity review, Lilly's liability is capped at $100, and the hospitals carry the full HIPAA compliance risk [2]. At UMass Memorial, the savings fund free care and dental services at 28 public schools [1].

## Lilly's defense, and an industry copying it

Lilly, which runs a $700 million research center in Boston, says the two largest hospital systems in Massachusetts "want to profit from it without transparency," sitting on data they already give insurers daily [1]. The company says the data is needed to catch hospitals double-dipping 340B savings against Medicaid on the same patients [1].

By June, Lilly said 70% of covered entities buying its drugs, about 2,350 organizations, had already submitted in-house claims data [3]. [Novo Nordisk](https://theinference.org/markets/companies/novo-nordisk) imposed a similar requirement effective April 1 [3]. Missouri's attorney general sent Lilly a cease-and-desist on October 26 after the drugmaker cut the University of Missouri Health Care's discounts in July; that system complied [2].

Lilly argues in the earlier suits, brought by Tampa General and Dartmouth's Mary Hitchcock hospital, that state-law claims are preempted and the dispute belongs with HRSA, the federal agency that runs 340B; neither judge has ruled [3]. The cost of refusal is on the record: [Lilly pulled Tampa General's discounts on June 18](https://www.beckershospitalreview.com/pharmacy/where-hospitals-340b-claims-data-lawsuits-against-lilly-stand/) and the hospital's per-unit Mounjaro price jumped overnight from $750.52 to $1,019.74, up 35.9%, an estimated $24.7 million a year [3].

## Read the complaint next to the earnings release

Lilly's Q3 2026 revenue rose 39% to $24.397 billion, and the company [raised full-year guidance to $91 billion to $92 billion](https://www.prnewswire.com/news-releases/lilly-reports-third-quarter-2026-financial-results-raises-full-year-guidance-and-highlights-regulatory-progress-across-the-portfolio-302922907.html), a $5.5 billion midpoint increase [4]. About $900 million of the quarter was not demand: $410 million in Jardiance milestones, none left after this, plus favorable rebate and discount adjustments [4].

The growth mix is the tell: volume up 53%, realized prices down 15% [4]. Discounts and rebates are precisely the gross-to-net line this fight squeezes, so the policy Lilly is defending and the record quarter rest on the same machinery. Investors shrugged for now: shares [climbed 2.32% to $1,442.01 in premarket trading on November 4](https://finance.yahoo.com/markets/stocks/articles/eli-lilly-stocks-rise-2-182325872.html) [5]. (The Inference charted Lilly's obesity duel with Novo on September 26 and its Dutch factory build-out on October 5; both predate this filing [5].)

## What decides it

No judge has ruled on the injunction requests in the Tampa or New Hampshire cases [3], and the Massachusetts complaint adds a consumer-protection claim with damages sought above the 340B ceiling price [2]. Watch the first preliminary-injunction ruling. If Lilly holds, every manufacturer gets the same toll booth on a statutory discount, collected hospital by hospital. If the hospitals hold, the discount flows with no string attached, and the data-for-pricing swap dies in Boston.

## Takeaway

A 340B court fight over patient data will decide whether manufacturers can toll a statutory discount, on the same gross-to-net line that just produced Lilly's record $24.4 billion quarter.
