# Four U.S. Bank callers sue Pegasystems and U.S. Bancorp for wiretapping at $5,000 a call in California

## Four callers met an uninvited listener

Ruben Juarez, Sean Marin, Brian Shultz and Benedict Lacovetti called U.S. Bank's customer service line from home and did what callers do: they read out addresses, account numbers, balances and the last four digits of a debit card [1]. ## The statute bills by the call

The suit runs on wiretapping law, two sections of California's privacy act plus the Massachusetts and Pennsylvania statutes, seeking $5,000 per violation in California and at least $1,000 in the other two states, with punitive damages and an order ending the interception [1]. The proposed classes cover residents of those three states who called the bank from a home, workplace or business in their own state, and had Pega record or monitor the call [1]. Pega, with 2025 revenue of $1.58 billion, markets U.S. Bank as a Voice AI customer [1][3].

## Whose cloud, whose defendant

The natural defense, the one Otter made in its own case, is that the assistant is the customer's tool [5]. The complaint's reply is the plumbing: audio streams to Pega's own cloud servers, not the bank's, which the plaintiffs say makes Pega an outside party with the ability to train its own models [1].

Pega bought the bones of the product in January 2021, a startup called Qurious.io whose software analyzed live calls for agents, emotion detection included [4]. ## The market had already hung up

PEGA was down 40.57% for the year as of the reshuffle, cut from Dan Ives's AI 30 on October 8 alongside [Oracle](https://theinference.org/markets/companies/oracle) while Dell went in, after September downgrades from JPMorgan and DA Davidson [7][9]. ## What the defense can say

Everything so far is allegation: the Otter ruling accepted the plaintiffs' pleadings as true and decides no merits, no court has tested the Pega complaint, and neither company has answered it publicly [1][5]. Pega has worn the defendant tag before and outlasted a $2 billion trade-secrets verdict on appeal [3].

## One adverse ruling from a bill
