# France voted 5.5 euro cents a gigabyte on Netflix, Google and Meta, and one word decides which cap applies

> France's National Assembly has adopted a levy of €0.055 per gigabyte delivered to French internet users, capped at 15% of French revenue or 2% of worldwide sales, with no wording on which ceiling binds. It is not law yet, and it lands on the biggest movers of data in the week Netflix touched a two-year low.

France has voted to price data delivery itself: 5.5 euro cents for every gigabyte sent to a French internet user, carried by the National Assembly on October 30 by 11 votes to 10, [against the government's advice](https://circleid.com/posts/french-lawmakers-back-per-gigabyte-internet-traffic-tax-despite-government-opposition) [1][4]. The levy is not law; the Senate can still strip it [1]. It matters anyway, because of where it lands. [Netflix](https://theinference.org/markets/companies/netflix) [touched a two-year low of $61.39](https://theinference.org/article/netflix-at-a-two-year-low-of-61-39-12-billion-of-cash-against-fewer-app-opens) this week [2], after [cutting 1,000 jobs](https://theinference.org/article/netflix-names-peter-rice-content-chief-and-cuts-1-000-jobs-as-2026-ad-revenue-forecast-falls-to-2-7-billion), about 6% of its staff, to defend margins [3], and this tax meters exactly what Netflix does most: moving video into homes.

## The carriers become the tax collectors

[Amendment I-1358](https://journalducoin.com/economie/taxe-gigaoctet-deputes-gta-6-netflix-bitcoin/), filed by the Socialist deputy Laurent Lhardit, writes a "tax on digital data producers" into French law [5]. Internet providers would count each content company's quarterly volumes, caching servers of content-delivery networks included, and report the figures to the tax office under Arcep, the telecom regulator [4][5].

Each sender would be identified by an IANA registration number, from the body that coordinates internet addresses; peer-to-peer traffic such as Bitcoin carries no such number, and the government doubts the counting can be done at all [5]. The amendment's own papers name Google, [Meta](https://theinference.org/markets/companies/meta), [Amazon](https://theinference.org/markets/companies/amazon), Netflix and [Akamai](https://theinference.org/markets/companies/akamai), a content-delivery network, as about half of French traffic, worth up to €10 billion a year to its authors [1][5].

## One word in the cap decides who pays

Liability stops at 15% of a provider's French revenue or 2% of its worldwide revenue, and the text writes « ou », "or", between the two ceilings without saying which applies [4][5]. Read as maximums, a service that earns only in France owes at most €2 on every €100 of sales, while a service that books most of its money abroad can owe up to €15 on the same €100 [4][5]. That comparison is this piece's arithmetic on the cap's wording, not a figure any source states.

Budget minister David Amiel [warns the burden may invert](https://www.universfreebox.com/article/598917/netflix-youtube-meme-tf1-bientot-taxes-pour-leur-trafic-sur-les-reseaux-des-operateurs-les-deputes-adoptent-finalement-un-amendement-qui-pourrait-rapporter-5-milliards-deuros), with nearly half the take coming from smaller, often French, providers [6]. Who actually pays is a drafting question nobody has answered.

## For Netflix, it presses on the margin line

Netflix's operating margin has held above 30% for three straight quarters [7][8]. The fourth-quarter guide bends down as the layoff charge lands [7]. A levy metered on volume and capped on revenue presses that same line, and the responses French coverage already names, higher French prices or lower bitrates toward French users, both tax engagement when viewing hours rose just 2% in the first half of 2026 [4][2]. The scope reaches past video to game stores, cloud drives, operating-system updates and AI model hosts such as [Hugging Face](https://theinference.org/markets/companies/hugging-face) [4].

## The template is already spreading

Ghana is running the other template. Its revenue authority has [moved collection of the country's 20% tax on foreign digital services to the moment of payment](https://www.techcityng.com/ghana-digital-services-tax-banks/); it gave no start date, Standard Chartered bank told customers it would begin applying the tax on October 15, and other banks are expected to follow [9]. Netflix, [Spotify](https://theinference.org/markets/companies/spotify) and ChatGPT subscriptions are all in scope, so both templates, Ghana's tax on the payment and France's tax on the gigabyte, land on the same Netflix subscription [9].

The Senate may still kill this vote, and that is not the point [1]. A national parliament has carried a bill that turns delivered volume into a tax base, and two problems are unresolved on the record: the government doubts the counting can be done, and attributing traffic that arrives through shared content-delivery infrastructure remains an open question [1][5]. Whoever builds the meter decides what this tax actually collects, and which of the two ceilings ends up mattering. Netflix holders should watch who builds the metering layer.

## Takeaway

France's Assembly adopted a 5.5 euro cent per gigabyte tax on big digital content providers, but the cap reads two ways depending on whether "or" means maximums, and the Senate can still strip the whole thing. Netflix, the biggest mover of data into French homes, just touched a two-year low with margins guided down, so who builds the metering layer decides what this tax actually collects.
