# Meta faces New Mexico's $35-40 billion penalty ask and Wall Street's $1,000 target in one week

> New Mexico has asked a judge to make Meta pay $35 to $40 billion for misleading Facebook users, and the ruling is expected this month, beside Wednesday's third-quarter earnings. Any bill now lands on a balance sheet already strained by AI-era capital spending.

## The only language Meta understands

[At a hearing on October 1 in Santa Fe](https://theinference.org/article/new-mexico-asks-a-judge-to-fine-meta-35-billion-to-40-billion-over-43-million-privacy-violations), Randi McGinn, outside counsel for the New Mexico Department of Justice, told state Judge Francis Mathew the court should "speak to [Meta](https://theinference.org/markets/companies/meta) in the only language it understands, which is money," and [asked him to order the company to pay $35 billion to $40 billion in civil penalties](https://finance.yahoo.com/markets/stocks/articles/mexico-asks-judge-order-meta-152024129.html) [1][3]. [A jury had found on September 25, after a two-week trial](https://www.usnews.com/news/top-news/articles/2026-09-25/meta-misled-consumers-in-case-over-cambridge-analytica-scandal-new-mexico-jury-says), that Meta misled state residents about the privacy of their data: more than 43 million violations, each carrying up to $5,000 under state law [2].

## A $36.55 billion spread, decided this month

The suit, filed by Attorney General Raúl Torrez in 2021, grew out of Cambridge Analytica, the British political consultancy that harvested data from as many as 87 million Facebook users through a third-party app [1][2]. Meta attorney Matt Nicholson called the request an "astronomical penalty" and [urged a $3.45 billion cap](https://finance.yahoo.com/markets/stocks/articles/meta-faces-40-billion-penalty-030056405.html), arguing the state never proved a consumer was actually misled [3]. Between the two sides' numbers sits a spread of $36.55 billion. Mathew said he expects to rule this month [1], and [Meta reports third-quarter results after the close on Wednesday, October 21](https://www.marketscreener.com/news/meta-to-announce-third-quarter-2026-results-ce785dddd880fe25) [4].

## The fine would land on a thinner cushion

Whatever Mathew orders lands on a cushion that has thinned. [Second-quarter revenue was $60.8 billion, up 28% year over year, but capital spending hit $30.1 billion and free cash flow fell to $1.7 billion](https://www.sec.gov/cgi-bin/browse-edgar?action=getcompany&CIK=0001326801), or $784 million on the estimate service TIKR's stricter count [5][1]. A $2.4 billion legal charge cut operating income 8% [1]. Meta holds $90.3 billion of cash and marketable securities against $112.3 billion of debt, more than double a year earlier [1][5]. It now owes bondholders more than it holds, and its bonds price above 7% in [a tech borrowing wave that reached roughly $500 billion in nine months](https://finance.yahoo.com/markets/stocks/articles/ai-borrowing-binge-rattles-us-011432895.html) [6].

## The bull case riding into Wednesday

Into that steps the Street's most aggressive call. [Truist](https://theinference.org/markets/companies/truist-financial) Securities analyst Youssef Squali this week [raised his target to a Street-high $1,000](https://finance.yahoo.com/technology/ai/articles/5-big-analyst-ai-moves-074804234.html), adding $28.5 billion of assumed revenue by 2030 from [Muse, Meta's AI agent launched on September 8](https://theinference.org/article/meta-plugged-a-13-3-billion-startup-into-its-free-agent-the-week-an-early-investor-sold-at-225x); the shares are up 21% since, against 2% for the S&P 500 [7]. Truist models $190 billion of 2027 capital spending, up 32%, and $63.9 billion of third-quarter revenue, the top of management's guidance [7].

## Meta bets that judges shrink what statutes multiply

Meta says it does not sell user data, that the verdict distorts its record, and that it can appeal whatever is ordered [1][3]. Statutory math multiplies to a ceiling no company could pay, and judges award less than states request: in New Mexico's youth-safety case this spring, a jury set penalties at $375 million and the judge ordered $567 million, after which Meta settled with 47 states for up to $16.7 billion, including $459 million for Cambridge Analytica claims [2]. New Mexico stayed out of that deal and went to trial instead [2].

## What the week decides

Two numbers decide the week: the figure Mathew writes, and whether Wednesday's release grows the legal line beyond $2.4 billion inside [an expense outlook of $165 billion to $169 billion](https://finance.yahoo.com/markets/stocks/articles/mexico-wants-meta-pay-40-133046305.html) [8]. The stock fell 8% on its last cash-flow shock [9]. One verdict comes from Santa Fe, one from Menlo Park, and one balance sheet answers for both.

## Takeaway

A New Mexico judge rules this month on a $35-40 billion privacy penalty against Meta, and Wednesday's third-quarter report lands on a balance sheet where $30.1 billion of quarterly capex has already cut free cash flow to $1.7 billion.
