# Meta's $25 billion fine hits the books long before it leaves the bank

> A New Mexico judge priced one state's privacy case against Meta at $25 billion, more than the roughly $17 billion the whole Cambridge Analytica affair had cost before. Meta will appeal; tonight's third-quarter report decides when the loss lands on the earnings.

A New Mexico judge ordered [Meta](https://theinference.org/markets/companies/meta) [on Wednesday to pay $25 billion for misleading users about how it handled their data](https://www.cnbc.com/2026/10/21/meta-new-mexico-cambridge-analytica-penalty.html), ending the trial phase of the state's lone suit over the Cambridge Analytica affair [1][2]. That affair broke in 2018, when a consultancy working for Donald Trump's 2016 campaign harvested information from as many as 87 million Facebook profiles through a third-party app [2].

Judge Francis Mathew wrote that the wrongdoing "goes to the heart of Facebook's core business practices" [2]. The $25 billion tops the roughly $17 billion that Cambridge Analytica-related litigation had already cost Meta [1][3]. Meta says it will appeal, so payment is years away; the first accounting question arrives sooner, in a third-quarter report that lands the same day [1][4].

## The penalty was priced for the share price, and the share price shrugged

New Mexico's lawyer Randi McGinn [asked for $35–40 billion](https://theinference.org/article/new-mexico-asks-a-judge-to-fine-meta-35-billion-to-40-billion-over-43-million-privacy-violations), telling the court to "speak to Meta in the only language it understands, which is money, and the value of its stock price" [2]. [A September jury found more than 43 million violations of the state's Unfair Practices Act](https://www.msn.com/en-ca/news/other/meta-ordered-to-pay-25-billion-to-new-mexico-after-jury-finds-company-misled-consumers-about-data-privacy/ar-AA2fL8Ol) [2]. The ceiling that produced ran past $219 billion, and Mathew cut it to $25 billion, with interest of 15% a year until it is paid [1].

Meta had [urged a $3.45 billion cap](https://theinference.org/article/one-judge-now-holds-meta-s-privacy-bill-and-the-bids-are-3-45-billion-and-40-billion) [2]. Its chief legal officer, C.J. Mahoney, said the suit seeks "to impose a tax on speech" and that Meta is confident it will prevail on appeal [1]. The market leaned the same way: the shares traded up almost 2% on the day [5]. Gil Luria, head of technology research at D.A. Davidson, said Meta is worth nearly $2 trillion and will likely keep appealing such cases and dragging them out, so the current set is unlikely to move its value [2].

## The bills have climbed from millions to billions, state by state

The order could be the largest penalty in Meta's history, and it joins a ladder [6]. The multistate class action over the scandal settled for $725 million in 2022, with New Mexico staying out and suing alone [3]. Earlier this year the same courthouse punished Meta's child-safety conduct in two phases, a civil penalty and a teen-mental-health fund [1][7].

In August, Meta [settled teen-addiction claims with nearly every other state for nearly $18 billion](https://arstechnica.com/tech-policy/2026/08/meta-settles-states-child-safety-claims-for-18b-florida-rejects-deal-as-peanuts/), a deal that changed the product as well as the balance sheet: two-hour default daily limits for minors and an overnight block [7]. New Mexico's penalty money is directed to its schools [2]. Florida rejected that deal as "peanuts" and promised a trial, and New Mexico priced its case outside the 2022 settlement cap, so the cycle has a next turn [3][7].

## Tonight the order meets the ledger

Meta [moved this report forward a week, to today](https://seekingalpha.com/article/4955775-ahead-of-schedule-meta-early-earnings-shift-driven-by-muse-ai-enthusiasm), so the ruling and the results share a date [4]. Second-quarter results already carried $2.4 billion of legal charges, and analysts expect roughly $10 billion more from the August settlement [8][9]. Tonight's earnings estimates run from $2.61 to $7.64, a range that is mostly disagreement about how much legal cost lands this quarter [8].

*Chart: **Booked, expected, ordered: Meta's privacy bill stacks up** Column chart comparing $2.4 billion of legal charges Meta booked with second-quarter results, roughly $10 billion analysts expect from the August settlement, and the $25 billion New Mexico order, which is under appeal*

US accounting books a loss once it is probable and can be estimated, which is why the August deal is expected in this quarter's numbers and why an order under appeal can reach tonight's too. The appeal then becomes a fight over cash timing, with 15% interest running as the meter on delay [1]. Whether the charge line moves tonight, and Florida's promised trial after it, are the next readings on whether state-by-state penalties have become a standing cost of Meta's data model [7].

## Takeaway

Meta's biggest penalty ever is under appeal with 15% interest running, but US accounting rules can put it on the books as early as tonight's third-quarter report.
