# Michigan voters cut CMS Energy off from the officials deciding its $443 million rate case

> Proposal 2 passed with 82% on November 3 and CMS Energy sued two days later. From about December 3 the utility cannot fund the Michigan politicians and regulators who rule on its $443 million rate case, a 1-gigawatt data center and a $27 billion buildout.

## Eight in ten voters said yes; the utilities went to court in two days

Michigan passed Proposal 2 on November 3, 2026, with [3,549,433 yes votes against 805,411, about 82%](https://www.clickondetroit.com/news/local/2026/11/04/michigans-proposal-2-faces-immediate-legal-challenge-after-majority-of-voters-support-it/) [1]. Section 30a, the provision it added, bars electric and gas utilities, their executives, their family members and their affiliates from contributing to state candidates, party committees and members of the Michigan Public Service Commission, the appointed board that rules on utility rates, while unions and advocacy groups keep that right [2].

## A tenfold fine, no cure, and a federal suit in two days

A violation carries a fine of up to 10 times the contribution, with no safe harbour and no cure by returning the money [2]. On November 5 [CMS Energy](https://theinference.org/markets/companies/cms-energy), Consumers Energy, [DTE Energy](https://theinference.org/markets/companies/dte-energy) and its subsidiaries, two political action committees and two individuals [sued in federal court in Grand Rapids to block it](https://www.clickondetroit.com/news/local/2026/11/08/michigan-voters-limited-utility-political-donations-heres-why-dte-consumers-energy-are-suing/) [2]. One plaintiff is DTE's treasurer; the other is his mother, covered solely because the law reaches executives' immediate family [2].

The other side is ready. Samuel Bagenstos, the University of Michigan law professor defending the measure, says it was [drafted with existing court decisions in mind](https://www.macombdaily.com/2026/11/08/lawsuits-challenge-money-out-of-politics-ballot-measure-on-first-amendment-grounds/); campaign manager Maura Cowley called the suit no surprise [3].

## The decisions that matter next all sit inside the ban's blast radius

Consumers Energy [wants $443 million of added electric revenue at a 10.25% return on equity](https://www.theglobeandmail.com/investing/markets/stocks/CMS/pressreleases/8603864/cms-energy-earnings-call-highlights-growth-and-risks/); commission staff back $265 million at 9.85%, and [the year's approved gas order landed at $139 million](https://theinference.org/article/six-banks-cut-cms-energy-before-michigan-cut-its-gas-increase-by-101-million), about 60% of that ask [4]. Meanwhile [an up-to-1-gigawatt data center Consumers agreed to serve](https://www.privatewealthdaily.com/story/cms-energy-expects-michigan-data-center-permitting-progress-after-midterms), reported as [Microsoft](https://theinference.org/markets/companies/microsoft), still works through zoning in multiple locations, outside the 745 MW of new contracts signed and 450 MW already energized [5][6][7]. Chief executive Garrick Rochow blames campaign "spin" for the opposition [5].

*Megawatts. The reported ceiling is the up-to-1-gigawatt data center Consumers Energy agreed to serve (reported as Microsoft, still working through zoning in multiple locations), shown as an estimate rather than a signed figure; alongside it, the 745 MW of new contracts signed and the 450 MW already energized. That is the machine at stake: a 10.5% rate-base growth target, a $27 billion buildout through 2040, 2026 adjusted EPS guidance of $3.83 to $3.90, and a negative [Moody's](https://theinference.org/markets/companies/moody-s) outlook on the utility [4]. Investors marked CMS down 2.12% on Friday [8].

## The pen now belongs to a judge

Certification lands November 23 and Section 30a takes effect around December 3 [2]. [The Mackinac Center's parallel suit](https://www.clickondetroit.com/video/news/2026/11/06/dte-consumers-energy-file-lawsuit-challenging-michigan-s-proposal-2/) attacks the disclosure rules reaching journalists and nonprofits [9]. Watch one thing: whether a federal judge freezes the ban before December 3, because that single order decides whether CMS argues its $443 million case funded or muzzled [9].

## Takeaway

A federal judge's order before December 3 decides whether CMS Energy argues its $443 million rate case funded or barred from funding the Michigan officials who rule on it.
