# Micron paid Netlist $600 million six days after Netlist's import-ban request; the cases stay open

> The memory maker settled all pending litigation with Netlist for $600 million on October 5, six days after Netlist asked the ITC to block imports of Micron's high-bandwidth memory. The check is one day of sales; the import dockets are the part still moving.

[Micron](https://theinference.org/markets/companies/micron) Technology, the US memory maker whose chips sit inside [Nvidia](https://theinference.org/markets/companies/nvidia)'s AI systems, agreed on October 5 to pay Netlist $600 million for a five-year license to the small memory-IP company's patent portfolio, [a deal Netlist disclosed the next day](https://finance.yahoo.com/technology/ai/articles/netlist-micron-enter-patent-license-120000503.html): $30 million a quarter from the fourth quarter of 2026 through the third quarter of 2031, with the agreements "settle[ing] and mutually releas[ing] all pending legal proceedings between the companies" [1]. Micron's own annual report confirms the October 5 agreement date [2]. Against Micron's last reported quarter, revenue of $54.2 billion and EPS of $33.40 against estimates of $51.5 billion and $31.80, the check works out to about one day of sales [3]. The board, separately, holds $35.16 billion of fresh buyback authorization usable from December 9 [4].

## What Netlist asked for six days earlier

The price tag only makes sense against the venue Netlist had just chosen. On September 29, Netlist went to the U.S. International Trade Commission, the federal agency that can block imports of infringing products, [seeking exclusion and cease-and-desist orders](https://www.morningstar.com/news/pr-newswire/20260929la58858/netlist-files-new-itc-action-against-micron-technology-inc-involving-hbm-patents-for-ai-computing) against Micron and its downstream customers Nvidia, [Broadcom](https://theinference.org/markets/companies/broadcom) and Google over two patents it says cover Micron's HBM3E, HBM4 and HBM4E chips [5]. HBM, high-bandwidth memory, is the stacked DRAM inside AI accelerators and the center of Micron's growth story: the company has shipped more than $1 billion of HBM4 revenue, ramping twice as fast as the prior generation [6].

[The complaint was the second front](https://theinference.org/article/a-small-patent-firm-just-put-a-us-import-ban-on-micron-s-84-6-margin-dram-on-the-table). A week before it, on September 23, the ITC had instituted Netlist's case over DDR5 server modules, [Investigation 337-TA-1523](https://financefeeds.com/itc-opens-netlist-patent-investigation-into-micron-memory-products/), naming Micron, Supermicro, [Hewlett Packard Enterprise](https://theinference.org/markets/companies/hewlett-packard-enterprise) and Lenovo [5][7]. And this is a campaign with wins behind it: a $445 million verdict against Micron in a Texas federal court in 2024, and a Samsung settlement in August after $421 million in verdicts in the same court [6].

*Patent awards and settlements Netlist has drawn from memory makers, in millions of US dollars: a $445 million Texas federal court verdict against Micron in 2024, $421 million in Texas verdicts against Samsung followed by an August 2026 settlement, and the $600 million five-year license Micron agreed to pay in $30 million quarterly installments from Q4 2026 through Q3 2031. Samsung chose a deal over a possible import ban in August; Micron made the same call. The license terms say what Micron bought: rights covering server DIMMs and high-bandwidth memory [1].

## The dockets have not moved yet

Here is the gap the press roundups have not closed: a settlement "between the companies" answers Micron's problem, but the ITC cases name customers that did not sign the release. As of October 10, [no ITC termination order had been verified on either complaint](https://old.reddit.com/r/Netlist_/comments/1x2ezq7/netlist_litigation_update_october_10_2026/), and in the California federal case Micron's October 8 stipulation merely extended its answer deadline to October 26, with no dismissal yet on the docket [2].

## Cheap against the quarter, real against the threat

The timing compresses the whole repricing. Six days separate the import-block request from the check, and in between Micron reported [revenue of $54.2 billion, beating estimates](https://x.com/unusual_whales/status/2105387964926951810) and topping the record $41.5 billion it set in fiscal Q3 [3][6]. The money is trivial for a company with a $24.4 billion net cash balance [4][6] and a 90 percent non-GAAP gross margin in its core data center unit [4].

*Chart: **Micron's revenue went from $6.8 billion to $54.2 billion in ten quarters** Line chart of Micron's quarterly revenue from the quarter ended May 2024 through the quarter ended September 2026, rising from $6.8 billion to $54.2 billion, with the steepest climb after the quarter ended February 2026.*

What Micron bought was the removal of a risk no hedge could cover: an exclusion order touching HBM3E or HBM4 would have reached systems built by Nvidia, Google and Broadcom, the buyers of the AI memory business [5]. The market spent Monday pricing a different threat: ChangXin Memory Technologies (CXMT), a Chinese DRAM maker, [promising DDR5 server modules by year end](https://finance.yahoo.com/markets/stocks/articles/netlist-files-trade-complaint-seeking-100129103.html), and [roughly $108 billion came off Micron, SK Hynix and SanDisk](https://www.benzinga.com/trading-ideas/movers/26/10/62303712/micron-sk-hynix-sandisk-wipe-out-100-billion-memory-selloff), about $52 billion of it from Micron [8].

## What to watch, with dates

Three dated events tell readers whether the check actually closed the file. October 26: Micron's extended answer deadline in California Case 8:26-cv-02167, with no dismissal yet on the docket [2]. At the ITC: termination orders on Investigation 337-TA-1523 and the September HBM complaint, which would confirm the release reached the import cases; Netlist has taken no docket step toward ending either since the settlement [2][5][7].

And mid-to-late December, Micron's next earnings read, where guidance will project whether the demand behind the $54.2 billion quarter holds against CXMT's year-end launch [3][4][8]. Until a termination order posts, the exclusion risk Micron paid to avoid is still formally alive.

## Takeaway

Micron paid Netlist $600 million six days after Netlist asked the ITC to block its HBM imports, but the release covers only the companies: the ITC dockets naming Nvidia, Broadcom and Google stay open until termination orders post, and Micron's California answer deadline runs to October 26.
