# Secaucus is drafting a ban on AI data centers after Equinix's 5,500-gallon diesel spill

> A diesel leak at Equinix's 24-year-old Secaucus campus took over seven hours to reach New Jersey's environmental hotline, and the town's reply is a draft ban on generative-AI data centers. Equinix, with $5-6 billion of 2026 capex to place, reports Q3 on October 28 with host-town goodwill now part of the bill.

Representative Nellie Pou, the Democrat whose district includes Secaucus, says [Equinix](https://theinference.org/markets/companies/equinix)'s campus there let diesel run for more than seven hours on September 11 before anyone called New Jersey's environmental hotline, and the town's answer is now on the table: a draft ordinance banning generative-AI data centers [1]. For Equinix, a real-estate investment trust that owns data centers and is worth about $98 billion, with $5-6 billion of 2026 capital spending to place [2], the bigger bill is likely political: a ban any host town can copy. The company reports [third-quarter results on October 28](https://www.ad-hoc-news.de/boerse/news/corporate-news/equinix-stock-costs-eur-887-80-ahead-of-october-28-results/70326739) [2].

## The ban covers facilities that had nothing to do with the spill

The accident was mechanical. During fuel polishing, a routine loop that circulates diesel through backup generators, debris jammed two valves and roughly [5,500 gallons overflowed](https://theinference.org/article/equinix-spilled-a-record-5-500-gallons-of-diesel-new-jersey-s-biggest-data-center-fine-was-1-07-million) into a storm drain feeding Anderson Creek, a Hackensack River tributary [4][5][1]. A security guard found the leak at 6:36 p.m.; the hotline call came at 7:43 p.m., [Pou's letter](https://hudsoncountyview.com/pou-secaucus-data-center-waited-over-7-hours-to-report-diesel-spill-to-njdep/) says [1]. The on-duty engineer who missed the alerts has been fired [1][3].

Secaucus officials say neither the spill site nor two campuses under construction were intended for AI operations, but the state's environmental agency described the site as an AI data center in September, and the council is drafting accordingly [3][6]. "I'm drafting an ordinance to specifically ban the AI generative data centers," Town Attorney Nick Strasser said on October 13 [3].

## Detection failed, and the rulebook never applied

[Equinix's incident report](https://brooklyn.news12.com/2026/10/14/equinix-releases-incident-report-into-secaucus-fuel-spill-local-officials-share-update/52SpEcXGxHd2GeA02PUTDr) puts the overflow at about four hours; its own timeline, like Pou's, runs from a possible 12:20 p.m. start to the 6:36 p.m. discovery, and the two accounts have not been reconciled [3][4]. The company has taken responsibility in a public letter and suspended fuel polishing across its U.S. sites pending review [4]. Worse: the New Jersey Department of Environmental Protection determined the campus is not subject to the state's major-facility discharge prevention requirements [1]. New Jersey has logged [three data-center fuel spills since 2017](https://www.nj.com/business/2026/10/nj-has-had-3-data-center-fuel-spills-since-2017-and-a-congresswoman-wants-answers.html), two of them at Equinix sites [5].

## Fines price the accident low, permits are the real cost

New Jersey's largest data-center penalty, $1.07 million against DataOne for unpermitted generators, shows how little the rulebook charges for these failures [5]. Politics charges more: more than 100 municipalities in the state have passed [data-center bans](https://theinference.org/article/with-no-data-center-bid-in-hand-columbus-county-votes-on-keeping-them-out) [5]. In Cape Town, [community groups' appeal](https://www.msn.com/en-za/news/other/activists-appeal-cape-town-data-centre-approval/ar-AA2cjg39) against Equinix's planned hyperscale campus at King Air Industria went before the city's planning appeals panel on October 12 [7]. Mayor Geordin Hill-Lewis now has 90 days to rule [8].

## Leak detection is the link the ordinance skips

The diesel came out of a maintenance loop whose alerts one engineer failed to answer, at a site the prevention rules never covered. The fix that pays is sensors, automatic shutoffs and a reporting path measured in minutes, sold to the diesel-backed campuses already standing, more than 280 of them Equinix's own [7]. Whoever builds that is closing the gap between the industry's build-out and the towns asked to host it, and deserves the reward. Three dates now price the politics: Equinix's results on October 28, which show whether the spill slows this year's capital plan; the ordinance's definitions, which decide what the ban actually stops; and the Cape Town ruling, which shows whether the same fight travels.

## Takeaway

A diesel spill handed Secaucus a template for banning AI data centers that any host town could copy, adding local goodwill to the bill Equinix must pay as it places billions in 2026 capital spending.
