# Shapiro asks to join PPL's rate case so data centers pay their own way on 31.8 gigawatts

> Pennsylvania's governor has asked regulators to let him join the case that sets PPL Electric's rates, the first gubernatorial intervention in a utility hearing in at least 15 years, his office says. At stake is who pays for a 31.8-gigawatt data-center pipeline: the data centers, or everyone else on the grid.

## A governor joins a rate case 18 days before Election Day

Pennsylvania Governor Josh Shapiro petitioned the state Public Utility Commission on October 15 for formal party status in the case that sets PPL Electric Utilities' rates, [announcing the move the next day](https://www.abc27.com/pennsylvania-politics/shapiro-seeks-to-join-case-against-ppl-citing-potential-cost-increases-caused-by-data-centers/) [2][1]. His office says no governor has intervened in a PUC hearing in at least 15 years [1].

Shapiro is backing a 425-page complaint filed on October 2 by the [Office of Consumer Advocate](https://www.timesleader.com/news/1762665/legislative-roundup-shapiro-files-petition-in-puc-case-to-protect-ppl-customers-from-higher-costs), the state office that represents utility customers, which argues PPL's rates leave customers [paying new or higher costs and exposed to interrupted service as data centers pile onto the grid](https://theinference.org/article/illinois-judges-move-to-halve-wec-s-gas-rate-hike-as-its-37-5-billion-data-center-build-rolls-on) [1]. His ask is specific: put large data centers in their own customer class, carrying the costs their demand creates. State agencies are themselves PPL customers [1].

## The fight is over 31.8 gigawatts of advanced-stage demand

[PPL Corporation](https://theinference.org/markets/companies/ppl), the NYSE-listed parent, told investors on its August earnings call that its Pennsylvania data-center pipeline had reached 31.8 GW in advanced stages: more than 11 GW under signed electric service agreements, more than 6.5 GW under construction, and two data centers that began taking service during the quarter, on track for roughly 2 GW of load by 2031 [3].

Capital spending ran $2.34 billion in the first half of 2026 against $1.72 billion a year earlier, with [about $5 billion planned for the year](https://www.insidermonkey.com/blog/ppl-corp-s-ppl-guidance-holds-steady-amid-a-data-center-gold-rush-1826303/) [4][3]. What PPL commits to wires and plants enters its regulated rate base, and this case decides who pays the return on it. Management separately pegs $10 billion to $12 billion of generation investment across Pennsylvania and Kentucky through 2032 as an opportunity it estimates, not committed spend, and separate from the 51%-owned [Blackstone](https://theinference.org/markets/companies/blackstone) joint venture [3][4].

## PPL says the tariff already assigns the bill

PPL's answer is that it solved this. It "advocated for, and secured approval of, Pennsylvania's only Public Utility Commission-approved large-load tariff," and separately filed a Consumer Protection Transmission Rider to keep broader system upgrades off other customers' bills [1]. Chief executive [Vincent Sorgi](https://theinference.org/markets/people/vincent-sorgi) says the tariff requires [long contracts, minimum demand payments, upfront collateral and termination fees](https://www.theglobeandmail.com/investing/markets/stocks/PPL/pressreleases/3757977/ppl-q2-earnings-call-highlights-data-center-investment-upside/) [3]. Pennsylvania rates still rose $275 million on July 1 [3].

## The administration recruited the load it now wants to police

The complication: Shapiro's own team courted this boom. In June 2025 his administration announced a $20 billion [Amazon](https://theinference.org/markets/companies/amazon) investment in AI infrastructure, saying it "worked closely with local leaders and Amazon" to land the deal [7]. In August 2026, with a Quinnipiac University poll showing [74 percent of Pennsylvania voters opposed to an AI data center in their community](https://www.msn.com/en-us/news/other/what-shapiro-s-new-data-center-order-does-and-doesn-t-force-developers-to-do/ar-AA2bKp3Y), he signed an executive order imposing his Governor's Responsible Infrastructure Development (GRID) standards and directing his administration to urge the PUC to keep data-center costs off consumer bills [7][6].

As of September 18, [no developer had signed the GRID agreement](https://www.bayjournal.com/news/policy/pennsylvania-governor-issues-order-on-data-center-development/article_05db31ff-3ede-46a5-9a3e-a5889d827ae7.html) [7]. Dan Diorio of the Data Center Coalition, a trade group, warned against changing rules "midstream" for projects already in motion [7]. The petition gives that order legal standing in a rate case [8].

## Party status and a hearing date are still undecided

The commission has set no hearing schedule; the open decisions before it are whether the governor's team may join as a party and how the Office of Consumer Advocate's complaint proceeds [1][2]. Shapiro [stands for re-election on November 3](https://www.pa.gov/governor) [7][9]. Watch the pipeline count PPL discloses each quarter: the share of those 31.8 GW actually under construction is the exposure the commission is being asked to price [3].

## Takeaway

Shapiro's entry into PPL's rate case makes the PUC, not the company's tariff filings, the arena where data-center cost allocation is decided, with 31.8 GW of pipeline and a November 3 election pressing the timing.
