# Snap runs out of settlements: first jury hears the Snapchat design defense this week

> Snap has settled its way past two bellwether trials, but jury selection begins this week in the first case it will actually defend, with Evan Spiegel testifying the same month Snap reports Q3. A first-ever Snap verdict now sets the public price for a docket whose benchmarks run to billions.

[Snap](https://theinference.org/markets/companies/snap) has paid to keep its design out of front of a jury twice. That run ends this week: jury selection begins in Los Angeles in the addiction trial where TikTok and [YouTube](https://theinference.org/markets/companies/alphabet) settled, [Meta](https://theinference.org/markets/companies/meta) bought peace with one of two plaintiffs, and Snap stands as a defendant. [Opening statements are set for November 4](https://www.afp.com/en/meta-snap-head-trial-another-case-about-social-medias-harms), with CEO [Evan Spiegel](https://theinference.org/markets/people/evan-spiegel) expected to testify from mid-November alongside [Mark Zuckerberg](https://theinference.org/markets/people/mark-zuckerberg) and Instagram chief Adam Mosseri [1].

The same day Snap reports Q3 earnings, so investors will price a jury's first read of Snapchat's design against the quarter's numbers in a single window [1][3].

## No jury has yet heard Snap's defense, and the benchmarks are billions

The money question is what Snap's settlement ladder was hiding. Snap settled the first bellwether before Meta and YouTube lost it for a combined $6 million, and settled the second before its August trial could start [1]. The benchmarks above it are enormous: a New Mexico judge just ordered Meta to pay $25 billion in a data-deception case, after a $942 million child-harm verdict, and Meta paid more than $18 billion in August to settle with 52 attorneys general [1].

No jury has heard Snap's defense, that Snapchat is private messaging rather than an algorithmic feed [1]. If that argument lands, the tail risk disappears at a discount. If it fails, the first-ever Snap verdict becomes the pricing event for a docket where plaintiffs start at 13 and 15 [1].

## The docket keeps feeding itself

[A complaint filed October 16](https://www.aboutlawsuits.com/roblox-lawsuit/snapchat-child-sexual-abuse-lawsuit-predator-targeted-9-year-old-girl/) alleges a predator posing as a child groomed a 9-year-old on [Roblox](https://theinference.org/markets/companies/roblox) and moved the contact to Snapchat, joining at least 180 Roblox exploitation suits consolidated before Judge Richard Seeborg, where a special master has opened settlement talks [2]. It's the cross-platform pathway, gaming as the entry point and disappearing messages as the cover, that Snap will now have to defend on its own.

For SNAP holders, what changed since [our last look at Snap's legal exposure](https://www.inference.example) is that the buyout option is gone: the company that always settled must now argue the product itself [1]. Watch the verdict, not the quarter.

## Takeaway

Jury selection begins this week in the first case Snap will actually defend, with opening statements set for November 4 and Evan Spiegel testifying from mid-November, the same month Snap reports Q3; a first-ever jury verdict on Snapchat's design now sets the public price for a docket benchmarked from $6 million to $25 billion.
