# SpaceX's AI revenue is set to more than double to $6.47 billion on turbines a Clean Air Act suit could shut

> Tonight's Q3 report prices an AI segment expected to become SpaceX's largest, built on gas turbines a Fifth Circuit fight could strip of legal cover, while the company buys out the neighbors suing it.

The AI segment that decides [SpaceX](https://theinference.org/markets/companies/spacex)'s quarter tonight runs on gas turbines a court could shut down, and the federal government is trying to make sure nobody can sue over them. [xAI](https://theinference.org/markets/companies/xai), [Elon Musk](https://theinference.org/markets/people/elon-musk)'s AI lab folded into the listed SpaceX, operates unpermitted gas turbines in Southaven, Mississippi, to power Colossus, the compute site behind Grok. The National Association for the Advancement of Colored People (NAACP) sued under the Clean Air Act's citizen-suit provision. Instead of enforcing the law, the Justice Department moved to intervene and dismiss, arguing Article II gives the executive exclusive enforcement power; when the district court did not rule, it appealed to the Fifth Circuit and asked it to stay the whole case. On October 16 the Constitutional Accountability Center [filed an amicus opposing that stay](https://www.theusconstitution.org/litigation/naacp-v-xai/) [1].

## Tonight's numbers are built on that plant

SpaceX reports Q3 after the close today, and the swing factor is AI [2]. [Consensus expects $6.47 billion of AI revenue, up from $2.56 billion in Q2](https://seekingalpha.com/news/4654451-spacex-q3-earnings-revenue-seen-surging-to-13b-as-ai-business-takes-centre-stage), which would make AI the company's largest segment [2]. The business exists because Grok has not drawn many customers, so SpaceX rents its spare compute instead, with [Anthropic](https://theinference.org/markets/companies/anthropic) and Google among the reported buyers [4]. The turbines are what keep those servers on: the company told a court that [an abrupt loss of power from Southaven would make Grok largely cease to function](https://www.yahoo.com/news/us/articles/spacexai-hearing-decide-future-southaven-100436668.html) [5]. [The NAACP counted 27 unpermitted turbines when it sued in April](https://arstechnica.com/tech-policy/2026/06/trump-admin-helps-xai-fight-pollution-lawsuit-says-military-needs-grok-for-war/); by mid-May there were 57, and 69 were on site by July [6][5].

## The neighbors are being bought, not answered

While the case sits on appeal, the company is closing on its plaintiffs' homes. [County records show subsidiary MZX Tech has bought three houses near the plant](https://desotocountynews.com/desoto-county-news/spacexai-southaven-homes-warehouse/), another lien has been filed against SpaceXAI, and some nearby renters were told to move out [3]. The buyouts, offered earlier this fall amid lawsuits and noise complaints, remove the neighbors exposed to the turbine noise and emissions rather than adding pollution controls at the plant [3]. Southaven's mayor has called the buyouts good corporate citizenship [3].

## What holders should watch

The Fifth Circuit's answer to the Article II question decides who carries the risk of every turbine-powered AI campus. If the government wins, the executive could decline to enforce the Clean Air Act against such plants and private suits over them would be blocked, giving the power backbone of a company worth about $2 trillion effective cover; that reading is the government's own position, not settled law [1][4]. If the NAACP's suit survives, the fastest-growing segment faces a plant with 60-some turbines and unresolved enforcement exposure [5]. At 68 times sales, SpaceX has little room for that to go wrong [4].

The chain here is short and observable: turbines power Grok and rented compute, rented compute is the revenue the market is paying for, and the turbines' legal footing is one court ruling away from changing. Tonight's earnings show how fast the segment grows. The Fifth Circuit decides what it is standing on.

## Takeaway

SpaceX's Q3 hinges on $6.47 billion of AI revenue that exists only because 69 unpermitted gas turbines keep Colossus running; tonight's numbers show how fast the segment grows, and the Fifth Circuit's Article II ruling decides whether anyone can still sue over the plant.
