# Tesla trades the Full Self-Driving name for Berlin's backing and a 10 percent leash

[Tesla](https://theinference.org/markets/companies/tesla)'s German website stopped selling "Full Self-Driving" on October 9, 2026 [1][2]. The product is "Tesla Assisted Driving," and [its own footnote states that current features require active driver monitoring](https://www.tesla.com/de_de/tesla-assisted-driving), making autonomous operation impossible [3]. At stake is a $99-a-month product with 1.48 million active subscriptions [2].

Germany's transport ministry called the old name misleading on October 6: the system never takes over the full driving task [1][2]. Tesla [offered the new name in September talks](https://thenextweb.com/news/germany-backs-eu-approval-tesla-fsd) with transport minister Steffen Bilger; [Elon Musk](https://theinference.org/markets/people/elon-musk) answered the endorsement with a "Danke schoen" on X [1][4].

## Software carries the multiple now

The urgency is financial. [Active FSD subscriptions rose 56% in the second quarter](https://www.cnbc.com/2026/07/22/tesla-tsla-q2-2026-earnings-report.html) [5]; the package sells for €99 a month in Europe [6]. Third-quarter deliveries of 486,532 beat a 461,974 consensus and still ran 2.1% below a year earlier [7].

Operating margin fell to 1.4% from 4.1% as operating expenses climbed 47% on AI and research spending [5]. The car business funds the bet, and most of the EU has yet to clear the software the rename is meant to sell [1].

## Berlin's backing comes with a leash

Bilger now wants Tesla drivers using the system across the EU "as quickly as possible" [1][4]. The price was set in September: the system may drive at most 10% above the posted limit, a position Berlin will argue in Brussels [1][4]. [The Dutch-approved build allows up to 50% over the detected limit](https://electrek.co/2026/10/09/tesla-fsd-renamed-tesla-assisted-driving-europe/), and the software as shipped often goes well past 10% [1].

The capability evidence is blunt. [A Belgian road-safety group found the system over the limit on 55% of the 30 km/h segments it tested in Brussels](https://theinference.org/article/tesla-s-fsd-read-30-showed-50-and-averaged-44-in-brussels), averaging 44 km/h [8]; an independent test drive there found the same [9]. Europe gets a slower car than the one Tesla ships at home, which still carries a "Mad Max" speed mode the Dutch approval excludes [6].

## The evidence underneath is contested

Musk has campaigned for years, writing in June 2025 that "FSD in Europe will save lives" and in March this year that the EU's "extreme regulatory burden" "stifles innovation" [10]. [Seven independent traffic-safety researchers who reviewed Tesla's safety evidence](https://insideevs.com/news/811098/tesla-pressure-campaign-europe-fsd-approval/) found too few test miles and "behavioral surrogates" that cannot show the system prevents fatal crashes [11].

Internal emails showed Tesla pressing the Dutch regulator RDW to reduce the rigor of its review; RDW calls the exchanges routine [11]. [NHTSA is separately investigating FSD over traffic violations across nearly three million Teslas](https://futurism.com/advanced-transport/tesla-basically-admitted-misleading-customers-fsd) [12][2].

## December decides

Eight EU countries have approved the system [1]. Bloc-wide approval needs 15 of 27 member states representing 65% of the population, and the Technical Committee on Motor Vehicles vote [has slipped to December](https://theinference.org/article/seven-yes-votes-and-a-sealed-file-tesla-s-europe-wide-fsd-slips-to-december) at the earliest, with France and Sweden objecting on speeding [1][8]. In unapproved EU markets, the same €99 buys "Tesla Assisted Driving Basic," roughly the old Enhanced Autopilot [8].

China already got "Intelligent Assisted Driving"; the US kept "Full Self-Driving (Supervised)," a label a California judge called unambiguously false in December 2025, still at $99 a month [1][2][12]. The name changed everywhere a regulator had leverage.
