# Texas's $3 million Temu settlement and a €2 EU fee turn the listing marketplace into a compliance business

> Texas's $3 million settlement, three same-day Irish recalls, a €2 EU fee and a Missouri suit are converting Temu's asset-light listing model into a compliance business, and PDD's margins are already paying for it.

[Temu](https://theinference.org/markets/companies/temu)'s whole model leaned on distance: millions of mostly Chinese third-party sellers carried the product liability while Temu, the Nasdaq-listed marketplace owned by [PDD Holdings](https://theinference.org/markets/companies/pdd-holdings), booked the take rate. October closed that gap from both sides of the Atlantic. On October 16 Texas Attorney General Ken Paxton [settled his February suit against Temu and PDD for $3 million](https://www.legalexaminer.com/lestaffer/home-family/are-temu-products-safe-settlement-targets-product-safety-and-data-privacy-in-texas/), but the binding terms matter more than the money [1].

## Texas's settlement reads like a retailer's manual

Under the Texas agreement Temu must store Texans' personal data on American-owned servers, restrict access from China, and pass annual independent security audits, with violations triggering $8 million penalties [1]. It must test products yearly for lead, phthalates, formaldehyde and PFAS, require compliance certificates before regulated goods even list, and pull unsafe listings within two business days, terminate the seller within five, and refund buyers [1]. That is a retailer's operating manual, imposed on a listing platform.

Ten days later the template surfaced in Europe. Ireland's competition authority [logged three Temu recalls on October 22](https://www.ccpc.ie/consumer-advice/product-safety/product-safety-notifications/details/temu-recalls-plush-doll-anna-frozen-sold-on-the-temu-platform), all choking risks from three different third-party sellers: plush toys with detachable parts, about 73 affected units in total [2][3][4].

## The bills arrive from every direction

A permanent [€2-per-item EU handling fee starts November 1](https://timesofmalta.com/article/eu-adds-new-charge-online-purchases.1136047), on top of July's €3 'Temu tax' on small parcels [6]. Temu signed Spain's Recyclia on October 26 to run seller waste compliance, part of 60-plus European scheme partnerships [5], and gave brand owners a 48-hour IP escalation channel on October 20 [7]. Every regime converts a listing into an operating cost that scales with SKU count. Sellers pay the testing and recycling bills; shoppers pay the fees; PDD carries the audits and settlements.

Missouri's attorney general [sued Temu on October 13](https://www.kttn.com/missouri-lawsuit-targets-temu-over-data-security-and-child-safety/), alleging the app was built to harvest locations, microphones and cameras, and urged residents to delete it [1][9]. Those are allegations, untested in court; Temu denied wrongdoing in Texas [1][9].

*Chart: **PDD revenue keeps climbing while profit slides** Line chart of PDD Holdings quarterly revenue in USD billions and net income margin in percent, Q3 2024 through Q2 2026, showing revenue growth alongside shrinking margins.*

*Quarterly revenue in USD billions and net income margin as a percent of revenue, from PDD Holdings' SEC filings, retrieved October 26, 2026. Net margin computed from reported revenue and net income. [8]*

PDD grew revenue every quarter for two years while net income slid in five of the last six, the compliance bill already visible before the fines arrive [8]. The stock [trades at 8.1 times earnings, down 39.5% in a year](https://sg.finance.yahoo.com/news/pdd-holdings-pdd-stock-looks-130811316.html), a multiple that prices in a chunk of this risk [10]. The open question: one-time cost of being allowed to operate, or a permanent margin line that caps the pivot to local sellers Temu is betting on. Watch November 1, when the fee lands [10].

## Takeaway

Texas's binding settlement terms, Irish recalls, a €2 EU fee and Missouri's suit turn Temu's asset-light marketplace into a regulated retailer, a cost PDD's shrinking margins already reflect.
