# WEC's $47.5 billion data-center bet meets its regulatory test in Chicago

> On October 29 WEC Energy printed record profits and a $47.5 billion data-center power plan; the same day, Chicagoans delivered 10,000 petitions against its gas utility's rate hike. The Illinois order due in November is the live test of whether that growth survives its regulators.

[WEC Energy Group](https://theinference.org/markets/companies/wec-energy-group) (NYSE: WEC) had two public moments on October 29 [1][2]. In Milwaukee it reported [record quarterly net income of $389 million](https://wgnradio.com/lisa-dent/people-gas-parent-company-makes-record-profits-while-residents-are-in-a-heating-affordability-crisis/) [1][2]. It also set out [a $47.5 billion capital plan for 2027 through 2031](https://www.ainvest.com/news/wec-energy-weather-flattered-beat-47-5-billion-data-center-growth-bet-2610/) [1].

In Chicago, consumer groups marched to the Illinois Commerce Commission carrying [more than 10,000 petitions](https://www.cbsnews.com/chicago/news/peoples-gas-rate-hike-protest-march-illinois-pirg-citizens-utility-board/) against the rate increase its Peoples Gas subsidiary wants [3]. Peoples Gas filed for a $202 million increase in January [3]. The current ask is $144 million [3]. Administrative law judges at the commission recommend approving just $66 million [3], and the commission's final order is expected in November [3]. That order is the clearest read investors will get this year on how regulators treat [a utility priced for data-center growth](https://theinference.org/article/arizona-s-ai-power-boom-now-turns-on-a-63-year-old-coal-plant-and-a-rate-case).

## The growth story runs through Wisconsin, and Wisconsin built the firewall

The plan's engine is 4.9 gigawatts of new electric demand by 2031, almost all of it from data centers [1]. That is a full gigawatt more than the previous plan assumed [1]. WEC is also in talks for another 400 megawatt project on top of the campuses under construction in Mount Pleasant and Port Washington [4].

A utility earns on that spending only if regulators let the costs into rates. Wisconsin's special electric rate, approved in April, makes data-center customers drawing at least 100 megawatts pay their own infrastructure costs [4]. "[The majority of this increase is being driven and therefore paid for by our very large customers](https://www.jsonline.com/story/money/business/energy/2026/10/29/wec-energy-group-in-talks-for-400-megawatt-data-center-project/92500804007/)," chief executive Scott Lauber said on the earnings call [4]. That tariff is the mechanism that makes the growth credible. Without it, this would be one more utility betting other people's bills on hyperscalers.

## Illinois is the part without the firewall

Peoples Gas delivers gas to nearly 900,000 Chicago customers [3]. Its pipe-replacement program is commission-ordered, and the utility calls the campaign against the rate case political [3]. But state data shows nearly one in five of those customers was at least a month behind on bills as of September [3].

Peoples Gas says its parent's profits have "practically nothing to do with" the gas utility, and formally that is true; the two are regulated in different states [2][3]. The difficulty is that the $47.5 billion plan carries the Chicago pipe work inside it: [WEC expects Illinois pipe-retirement spending to reach roughly $500 million a year from around 2028](https://finance.yahoo.com/energy/articles/wec-energy-group-wec-said-031356224.html) [5]. November's order prices that recurring spending, not just this case.

## November's order prices the whole plan

The market pays about 20.5 times forward earnings for this growth story [1]. The quarter that justified the optimism was partly weather: strip out warm temperatures and the very large customers, and retail electricity deliveries rose 0.4% [5].

I want these data centers built, and WEC's Wisconsin structure is the right way to build them: make the beneficiary pay, and the growth survives scrutiny. Illinois shows the other path. A utility that spends on a mandate without a payer firewall runs into affordability politics, and judges cut its ask in half. One in five customers behind on the heating bill is what happens when a utility loses sight of who pays.

## Apply the Wisconsin firewall everywhere

The fix is structural: [apply the same tariff logic everywhere](https://theinference.org/article/a-tariff-duke-is-writing-in-south-carolina-decides-who-pays-for-ai-s-power-plants), not only where hyperscalers happen to locate. Watch the commission in November. An order near the judges' number confirms that regulators will cut hard during an affordability crisis, and every future rate case in the plan gets filed with that precedent in mind. An order near the full ask would tell investors the affordability pressure is noise. Either way, the read on the plan comes from Chicago this month, not Milwaukee.

## Takeaway

The Illinois Commerce Commission's November order on Peoples Gas' $144 million rate ask, against the judges' $66 million recommendation, is the first test of whether utility data-center growth can survive affordability politics.
