Eli Lilly files 11 suits against retatrutide sellers before the drug even wins FDA approval

Eleven federal suits target sellers of an unapproved obesity drug before launch day. With Q3 earnings on October 29 showing 60% volume growth against a 13% price decline, Lilly is buying court protection for launch-year revenue.

Eli Lilly+0.38% — Eli Lilly, up 0.38 percent today has filed at least 11 federal lawsuits against online vendors and wellness clinics selling copycat versions of retatrutide, its experimental weight-loss drug that no regulator anywhere has approved, Bloomberg Law reported on October 26 1. One suit surfaced this week: Lilly sued American Peptides LLC on October 8 in federal court in Louisiana, case 5:26-cv-04146 2. Lilly is suing sellers of a molecule that is not yet on shelves, ahead of its own launch.

A checkout page is the evidence

The complaint alleges the vendor's "research use only" label is a pretext for human sales, citing an auto-selected reconstitution solution at checkout, syringes and bacteriostatic water sold alongside, subscription plans, influencer affiliates posting weight-loss results, and a wholesale "Clinic" tier aimed at clinics and compounding pharmacies 2. These are allegations, not court findings.

The campaign is not new, only bigger. On August 12 Lilly sued six sellers, including Aesthetic Envy, Legendary Peptides and Texas Peptides, and said it had referred more than 200 individuals and entities to the FDA and the Justice Department, plus more than 14,000 websites, ads and listings to platforms and e-commerce companies 34. Six suits in August, at least 11 by late October: the docket is doubling faster than the drug is moving through trials 34.

Why Lilly will not wait for approval

Lilly's chief medical officer, David Hyman, put the position plainly in August: what is sold on the black market "is not a medicine" 3. The FDA has said retatrutide cannot legally be compounded or sold 4. On timing the sources split: The Hill reports Lilly is expected to submit retatrutide to the FDA by the end of the year, while Healio puts the filing in the first quarter of 2027 34. Either way, the gray market gets a head start.

The gray market is already delivering

The scale behind the lawyering: a July Gallup poll found that of US adults taking GLP-1 drugs for weight loss, nearly one in five uses compounding pharmacies, about 5 million people on compounded copies overall 5.

Last week Apothecary Pharma, a North Carolina compounding pharmacy, recalled 22 multi-dose vials of compounded tirzepatide, the active ingredient in Lilly's Zepbound, because sterility could not be assured, an FDA-labeled Class II recall following a December 2025 warning letter 6. The gray market is already delivering unverified product, which is the exact risk Lilly is litigating against before its own filing.

The money says why Lilly moves first. TIKR consensus sees third-quarter revenue of about $22.6 billion on October 29, slightly below Q2's $22.97 billion, even though worldwide volume rose 60% in Q2 against a 13% price decline 7. Every sale leaking to an unapproved seller hits a franchise already fighting price. Watch Wednesday's volume-and-price split, and whether the docket keeps growing.
