A judge called xAI's turbines what they are, and now Grok's power bill has a court date
Judge Debra Brown has let the NAACP's Clean Air Act suit against xAI's unpermitted turbine fleet proceed, just as Musk admits serving Grok Bot costs more than subscribers pay. The same week, xAI announced two more Tennessee sites on the same fast-power playbook.

A federal judge has ruled that the 27 trailer-mounted gas turbines powering xAI's$200B — xAI, private, latest valuation $200B Colossus 2 data center are stationary pollution sources that needed permits, not "mobile sources" that dodge the Clean Air Act 12. Judge Debra Brown of the Northern District of Mississippi denied xAI and its subsidiary MZX Tech's motion to dismiss on October 30, letting the NAACP's suit head toward remedies: emissions controls, offsets, curtailment or penalties 12.
For investors in SpaceX+3.15% — SpaceX, up 3.15 percent today (SPCX), which now owns xAI, that turns power cost from a footnote into a dated legal risk. It lands the same week Musk admitted serving Grok Bot costs are "unsustainably high relative to revenue" 46.
Every escape route failed, twice
The court rejected all of xAI's arguments. Sitting on a flatbed trailer does not make a combustion turbine mobile under Mississippi's air rules; a state agency letter did not bind the court; and the NAACP has standing to sue, so citizen enforcement does not usurp executive power 123.
The Justice Department tried twice to kill the case, arguing an outage would threaten national security because the Pentagon runs the Grok Gov Model in Maven targeting systems. Brown denied the DOJ's motion on October 19, calling national security concerns not relevant, and xAI's own motion fell eleven days later 3.
Growth made Grok's bill worse, not better
Here is the chain that matters. The turbines feed Colossus 2, which serves Grok Bot, an AI agent that keeps working rather than answering one question, so every extra hour burns chips 45. Growth made the bill worse, not better: 800,000 paying weekly users in early October, double the prior month, on flat $30 to $200 monthly plans 45.
Musk throttled those users without notice rather than raise the price 4. If the court next orders controls or curtailment, the power under this money-losing product gets more expensive — or the chips behind SpaceX's $7.6 billion AI revenue quarter sit idle 5.
The playbook the court declined to excuse is still running
xAI is not slowing down. Two more Tennessee sites, "Gun Range" and "Spam," join Colossus 2 by December 7, and EPA's rule strips temporary status from any turbine that stays put past 24 months 1.
Whoever builds the gap between raw compute and a compliant power supply is doing the work that creates durable value. Until then, SPCX's AI margin story is priced on cheap, unchallenged electricity that just stopped being a safe assumption.
