203 protests, six intervenors: Oklahoma decides Monday who can fight AEP's power line

A judge would recast 203 protests as comment

The Oklahoma Corporation Commission↗ meets Monday at 1:30 p.m. on Administrative Law Judge Carly Ortel's recommendation↗ to treat 203 landowner notices of protest as "public comment" ¹. Party status would go to five landowners with property in Washington or Nowata counties, and to Protect Rural Oklahoma, the group Ben and Natalie Bullard founded in Welch; a protective order bars it from sharing discovery materials with its members ¹.

The line is long, mandated, and AEP is spending like it's approved

At stake is the Oklahoma leg of the Branson 345 kV overlay, a 316-mile Southwest Power Pool chain from the Buffalo Flats substation near Garden Plain, Kansas, into northeast Oklahoma and toward Branson, Missouri, with construction slated for summer 2028 through late 2029 ¹³. Parent American Electric Power spent $13.4 billion on capital projects in the four quarters through June 2026↗, and first-quarter spending ran 81% above a year earlier ⁶.

Kansas settled the route. Oklahoma is settling the guest list.

Kansas regulators ruled on their piece of the same chain in May, approving the leg west of U.S. 77 and refusing the crossing into the Flint Hills↗, with a new routing study ordered ². In Oklahoma, the live question is no longer where the line goes but who is allowed to argue about it.

Six tribes sit outside the two-county box

The Wyandotte Nation, federally recognized with about 7,150 citizens and headquartered in Wyandotte, Oklahoma ⁸, was denied intervention: its reservation lies in Ottawa County, outside the case's Washington and Nowata scope, and its filing contends the line would run directly through those 20,000 acres ¹. The Eastern Shawnee, Modoc, Ottawa, Peoria and Quapaw nations filed objections citing cultural practices, bird collisions and noise ¹.

A 2025 law wrote this fast-track

House Bill 2756, the High Voltage Electric Transmission Facility Act↗, passed the House 85-4 and the Senate 43-0 and became law without Governor Kevin Stitt's signature on 28 May 2025 ⁵. The commission now runs a dedicated certificate-of-authority docket for high-voltage lines under it ⁷. OK Transco filed in June, before the new rules took effect on 1 August; the Attorney General found the company had "complied with those requirements regardless," and the companion East case, filed in August, is queued behind it ¹³.

The judge made the Attorney General the landowners' stand-in

Jeffrey L. Ellis, AEP's director of SPP transmission and distribution planning, testified that a one-to-two-year delay would heighten the risk of thermal overloads, voltage issues and load shedding like Winter Storms Uri and Elliott ¹. The landowners' protest forms list "no quantification of rate impacts on customers" among their objections: a cost the certificate imposes that nobody has priced ¹.

The company says it adjusted routes after feedback and that anyone may participate in the commission's review ⁴. Judge Ortel held the protesters' interests "appropriately represented" by the Attorney General and Protect Rural Oklahoma; the AG's office does not object to the certificate ¹.

Monday sets the template; the East case is next

Bullard, denied individual status because his land sits in a family trust, is challenging that ruling in a new filing ¹. AEP justifies this line with winter storms, not data centers ¹. Every AI-load forecast eventually lands on somebody's map, and Monday's vote on who gets a seat decides how fast the ground under the wires gets cleared.
