ElevenLabs launches AI music tool days after a publisher priced unlicensed training at $150,000 a song
The voice-AI company launched Instant Soundtrack on October 26, five days after a publisher priced unlicensed AI music training at $150,000 a song in federal court. Licensing is now ElevenLabs' moat and its margin bill.

ElevenLabs launched Instant Soundtrack on October 26, 2026: upload a video, and the software writes original music and sound effects scene by scene, switching from EDM to acoustic guitar as the mood shifts, delivered as separate editable layers, up to ten videos per API request 12. It is built for ads and short-form production, the exact workflow where background music used to be two extra hires.
The timing is not subtle
On October 21, Reservoir Media, the Nasdaq-listed publisher (RSVR) behind Joni Mitchell and Johnny Cash catalogs, sued Suno for $157.5 million in statutory damages over 1,050 compositions, up to $150,000 per work, in the Northern District of California 3.
The complaint cites leaked code showing 2,057,486 artist records from YouTube−0.36% — YouTube, down 0.36 percent today Music and roughly 113,879 hours of scraped audio, and a Munich court had already ruled in July that Suno~$2.45B — Suno, private, latest valuation ~$2.45B circumvented YouTube's rolling cipher 3. Suno defends on fair use 3. ElevenLabs~$3.3B — ElevenLabs, private, latest valuation ~$3.3B enters AI music from the other side: its Voice Library pays more than 10,400 licensed creators, and Reservoir's own filing names ElevenLabs among companies that "seek permission and pay rights holders" 37.
Reservoir's damages ceiling on Suno reaches $186 million across three counts
Data
| Value | |
|---|---|

The licensed path is a margin bill
The private market just marked it. Wilson Sonsini advised on a $300 million ElevenLabs employee tender offer 4, and the RVI fund's NAV rose to $29.20 from $25.02 for the quarter ended September 30, "due in part to" rounds or tenders including ElevenLabs 5. Tender buyers now own the question of whether licensing costs and premium pricing can coexist.
Demand-side, the answer is unsettled. A video producer who canceled this month says the $22 Creator tier, about 100,000 characters, burned into $60 to $90 bills through overages, pushing high-volume work to free deterministic Azure engines 6. Quality is not the complaint; the meter is. Meanwhile ElevenLabs' models rank first on all five new Voice Arena TTS leaderboards, voted on blind by native speakers 8, and its realtime translation covers 90-plus languages with Deutsche Telekom integrating it 7.
Watch the docket
Watch the Reservoir docket and Suno's answer: if statutory damages land near the Anthropic$350B — Anthropic, private, latest valuation $350B settlement's roughly $3,000 per work 3, licensing becomes cheap by comparison, and ElevenLabs' head start becomes the moat. If courts buy Suno's fair-use defense, the moat is just a cost.
